1.Interpretation

Unless the context requires otherwise: (a) singular includes plural and vice versa; (b) headings are for convenience only;(c) references to laws include amendments and successor laws; (d) 'including' means 'including without limitation';(e) references to the Platform include the website, mobile applications and related services.

2.Defined Terms

Accommodation

Any lodging offered through the Platform including hotels, motels, cabins, cottages, vacation homes, campgrounds, lodges, inns, bed & breakfasts or similar.

Advertising Services

Paid promotional products offered by the Platform.

Applicable Law

All applicable federal, state, county, municipal and local laws, regulations, ordinances, permits and governmental requirements.

Booking Referral

A reservation request or confirmed reservation originated through the Platform.

Booking Request

A guest request to reserve an Accommodation.

Community Standards

The Platform's published conduct, content and safety standards.

Content

Text, photographs, videos, logos, descriptions, reviews and other materials submitted or displayed.

Editorial Content

Destination guides, rankings, articles, recommendations and other content created by the Platform.

Fees

Referral fees, commissions, subscriptions, sponsorships, advertising charges or other agreed amounts.

Force Majeure

Events beyond reasonable control including severe weather, wildfire, flooding, ice, utility failures, government action and similar events.

Guest

Any person using the Platform to browse, request or reserve an Accommodation.

Host

The owner or authorized manager of an Accommodation.

Intellectual Property

All copyrights, trademarks, trade dress, patents, trade secrets and other proprietary rights.

Listing

A Host-created property profile displayed on the Platform.

Merchant of Record

The party legally responsible for payment processing. Unless expressly stated otherwise, AdirondackRegion.com is not the Merchant of Record.

Mobile Application

The official AdirondackRegion.com mobile application.

Platform

AdirondackRegion.com, its website, mobile applications and related services.

Platform Services

Marketing, discovery, reservation request transmission, booking referral, listing management, communications and related services.

Property

A Host's Accommodation and related premises.

Referral Fee

A fee earned by the Platform for qualifying bookings under an applicable agreement.

Reservation Confirmation

A Host approval of a Booking Request.

Sponsored Listing

A paid promotional placement or enhanced visibility product.

User

Any Host, Guest or other Account holder.

Website

The internet site operated under the AdirondackRegion.com domain.

3.Drafting Conventions

All future agreements in the AdirondackRegion.com legal library incorporate these definitions unless expressly modified. Capitalized terms have the meanings assigned in this document. If a conflict exists between this document and a later agreement, the later agreement controls solely for that agreement.
