Marketplace Integrity & Anti-Circumvention Policy.
Version 1.0Operational Policy – Incorporated by Reference into the Host Listing & Participation Agreement, Guest Terms of Service & Booking Agreement, and Payment Authorization & Billing Agreement.
1.Purpose
This Policy protects the integrity of the AdirondackRegion.com marketplace by ensuring that Hosts and Guests who are introduced through the Platform do not intentionally circumvent the Platform's booking referral process or applicable referral fees.
2.Covered Introductions
A Covered Introduction occurs when a Guest first discovers, inquires about, favorites, messages, or requests a reservation for a property through AdirondackRegion.com, regardless of whether the reservation is ultimately completed immediately.
3. Anti‑Circumvention
Hosts and Guests agree not to knowingly structure transactions for the purpose of avoiding Platform referral fees after a Covered Introduction. This includes directing a Guest to book outside the Platform after initial introduction, encouraging off-platform payment solely to avoid Platform fees, or using alternate business names, websites, phone numbers, or intermediaries to evade referral obligations.
4.Referral Attribution
Unless otherwise agreed in writing, AdirondackRegion.com may attribute a Covered Introduction to the Platform for a period defined in the applicable commercial schedule. The attribution methodology (including cookies, authenticated sessions, referral identifiers, or other technologies) is proprietary and may change over time.
5.Repeat Guests
The Platform may establish separate commercial rules governing repeat guests, annual return visits, or direct re-bookings. Those rules shall be published in the Host commercial schedule and incorporated by reference.
6.Audit Rights
Where a good-faith dispute exists concerning referral fees, AdirondackRegion.com may request reasonable documentation sufficient to verify whether a Covered Introduction resulted in a completed reservation. Any review shall be limited to information reasonably necessary to resolve the dispute.
7.Exceptions
This Policy does not prohibit lawful direct business relationships that did not originate through the Platform or circumstances where AdirondackRegion.com expressly waives referral rights in writing.
8.Remedies
In addition to any other rights under applicable agreements, AdirondackRegion.com may recover unpaid referral fees, suspend Listings, terminate participation, or pursue other remedies available under contract or law where intentional circumvention is established.
9.Good Faith
The Platform recognizes that inadvertent errors may occur. Hosts are encouraged to promptly notify AdirondackRegion.com of any mistaken booking workflow so that issues may be resolved cooperatively.
10.Relationship to Other Agreements
This Policy supplements all commercial agreements between AdirondackRegion.com and participating Hosts. Where a conflict exists regarding referral fee administration, this Policy governs unless a negotiated written agreement expressly provides otherwise.
